Grounds for Divorce in Maryland
Maryland significantly simplified its divorce law effective October 1, 2023. Fault-based grounds like adultery, cruelty, and desertion no longer apply, and the old 12-month separation requirement is gone. Today, spouses can obtain an absolute divorce in Maryland on one of three grounds:
Mutual consent — both spouses sign a written agreement resolving property, support, and custody, and at least one spouse has lived in Maryland long enough to meet residency requirements.
6-month separation — spouses have lived separately (or separately under the same roof, maintaining distinct lives) for at least six months.
Irreconcilable differences — the marriage has broken down and cannot be repaired, without needing to prove either party is at fault.
Maryland still requires that at least one spouse has resided in the state for the applicable period before filing, so residency should be confirmed early in the process.
