Child support orders carry real financial weight for both parents, and the terms set at the outset can shape a family’s finances for years. Child support applies to parents regardless of marital status. Any time parents live apart, both carry a legal obligation to financially support their children under DC law. Getting that obligation calculated accurately from the beginning matters.

How Washington, DC Calculates Child Support

DC Code § 16-916.01 governs how child support is determined in the District. DC uses the income shares model, which begins by calculating each parent’s gross income from all sources, including wages, bonuses, royalties, dividends, pension income, capital gains, unemployment benefits, and more. Alimony a parent pays is subtracted from that parent’s gross income before the calculation runs. Public assistance benefits are excluded, as is income received on behalf of a child who isn’t subject to the support order.

Once both parents’ adjusted gross incomes are established, the court combines them and applies that total to DC’s Schedule of Basic Child Support Obligations. Each parent’s share of the obligation is proportional to their percentage of the combined income. Additional factors that affect the final figure include childcare costs, health insurance coverage, extraordinary medical expenses, and existing support obligations for other children.

Factors That Can Shift the Calculation

Custody time and imputed income are two variables that can move the numbers significantly:

• Shared physical custody adjustment: When a child spends 35% or more of the year with a parent, a shared physical custody presumption applies and adjusts that parent’s support obligation under DC Code § 16-916.01.
• Imputed income: If a court finds a parent is voluntarily unemployed or underemployed to reduce that parent’s support obligation, it may assign an income figure based on earning capacity rather than actual earnings.
• Guideline departures: A court may authorize a support amount that differs from the guideline when strict application would be unjust, provided the order states the reasoning.

Establishing, Modifying, & Enforcing DC Child Support Orders

Establishing a New Order

When parents weren’t married, legal paternity must be established before a court can enter a child support order. This can happen through voluntary acknowledgment, DNA testing, or birth certificate documentation. 

Once paternity is confirmed, we work to establish an order that accurately reflects both parents’ incomes and the actual costs of raising the child. DC child support continues until the child turns 21, which differs from many other states and makes accuracy in the initial order especially important.

Seeking a Modification

Either parent can petition for a modification when a substantial and material change in circumstances has occurred. Common triggers include a significant income change, job loss, relocation, or a shift in the custody arrangement. 

Under DC Code § 16-916.01, there is a presumption that a substantial change exists when applying current guidelines to current incomes would produce a difference of 15% or more from the existing order. The court may also grant retroactive child support going back up to 24 months when circumstances warrant it.

Enforcing an Existing Order

When a parent stops paying, DC courts have enforcement tools that go well beyond a reminder letter. Consequences for non-payment include wage garnishment, liens on property, suspension of driver’s and professional licenses, seizure of tax refunds, credit reporting, and passport denial. 

The DC Child Support Services Division (CSSD) administers and enforces support orders, and we can pursue contempt and enforcement actions on your behalf when a parent isn’t complying.
